Are you ready for the next steps on the UKCA timeline?

Now that we’ve moved beyond the 1st of January 2021 and the UKCA mark has been established as the product conformity mark for products placed on the GB market, your focus should shift to ensuring that you are ready for the next major date on the UKCA timeline, the 1st of January 2022.

Any existing products that carry the CE mark can continue to be placed onto the GB market until the end of 2021 (alongside new products that carry the UKCA mark), giving manufacturers time to move existing stock and transition to the new regime.

From 1st January 2022, this is no longer the case, and you need to be prepared and take action now to ensure you can continue to place your products on the GB market.

In simple terms, if your Ex product does not carry a UKCA mark and is not supported by a UKCA Ex Certificate issued by a UK Approved Body, it cannot be placed onto the GB market after 31st December 2021.

What action do you need to take?

For existing products that you intend to continue to place onto the GB market after the end of 2021, you will need to have these reviewed and, where one does not exist, have a UK Approved Body issue a UKCA Ex Certificate. Once this is complete and the appropriate certificate issued, you can use the UKCA mark to show conformity with the UK legislation, and the product can continue to be placed onto the GB market after the end of 2021.

An appropriate Declaration of Conformity will be required, as well as the relevant supporting technical information.  Eurofins CML, as your UK Approved Body, will be able to provide guidance and assistance to ensure this is in place.

For new products, you should work with a UK Approved Body to issue a UKCA Ex Certificate. They should also support you throughout the certification process, ensuring that you have appropriate certification in place alongside the other essential components of regulatory compliance, the Declaration of Conformity and a Technical Construction File.

Can a product carry both a UKCA mark and a CE mark?

This topic has raised questions for many companies now that different regulatory regimes are in place. A product can carry both a UKCA and a CE mark (and any other relevant markings such as the certificate number and the Approved/Notified Body Number) provided that it continues to meet the essential requirements for both markets.

You will, of course, need to maintain both certificates, Declarations of Conformity and supporting information for both markets. You must also ensure that any changes or divergence between UK and EU legislation or standards is reviewed, and where necessary, are reflected accordingly.
